Kentucky bishops back bill to allow ‘alternative sentencing’ for criminals with children

TheCatholicbishopsofKentuckyarebackingproposedlegislationthatwouldrequireacourttoconsideralternativesentencingforconvictedcriminalswhohaveyoungchildren. Themeasure statesthatKentuckywishesto“promote,strengthen,andencouragefamilylifefortheprotectionandcareofchildren”and“maintainthefamilyunitwithanemphasisontheparent-childrelationship.” Parentalincarcerationisclassifiedasan“adversechildhoodexperience,”thebillnotes,whichcanleadtopoormentalandphysicalhealthoutcomesandincreaseachild’schancesofcriminalactivityinturn. Thebillwouldrequirecourtstoconsideraconvictedcriminal’s“statusasaprimarycaretakerofadependentchild”beforeimposingasentence.Acourtwouldberequiredto“consideranalternativesentence”insuchcircumstanceswhileweighingtheparent’scriminalhistory,theseriousnessofthecrime,andotherfactors.  Violentoffenderswouldbeexcludedfromtherule,aswouldcriminalswhosevictimswerechildrenaswellasthosewhoareineli
